Terms of Service

You must be at least 13 years old to use FestBites. You are responsible for your account and for keeping your password secure, and for everything that happens under your account. Give us accurate information and keep it up to date.

You keep ownership of the photos, reviews, ratings, posts, and other content you submit. But so that we can operate and promote the app, you grant FestBites a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, host, store, copy, reproduce, modify, adapt, publish, display, and distribute that content - including any photos and images you upload - in connection with the app and its promotion and marketing, across any media now known or later developed, without any payment to you.

By submitting content, you represent and warrant that:

• You own the content or have all rights needed to grant the license above.
• If the content shows other identifiable people, you have their permission for it to be uploaded and used as described.
• The content does not infringe anyone's rights or break any law.

This license continues even if you stop using the app, to the extent needed for content you already shared (for example, a photo that others have already saved or that appears in aggregate data). You can delete your content, and we will stop displaying it going forward.

Do not use FestBites to:

• Post content that is illegal, harassing, hateful, deceptive, or infringing.
• Impersonate others or misrepresent your affiliation with a person or vendor.
• Upload someone else's photos or private information without permission.
• Spam, scrape, or attempt to disrupt, overload, or reverse-engineer the app.
• Post fake reviews or otherwise manipulate ratings.

We may remove content or suspend accounts that break these rules.

Tips and any other payments are processed by Stripe and are voluntary. Unless required by law, tips are non-refundable. You are responsible for any taxes that apply to payments you make or receive.

FestBites is provided "as is" and "as available," without warranties of any kind. Reviews, ratings, and photos are submitted by users; we do not endorse them and do not guarantee that any information about a vendor, dish, or festival is accurate, complete, or current. Use your own judgement, especially regarding allergens and food safety.

To the fullest extent permitted by law, FestBites and its operator will not be liable for any indirect, incidental, or consequential damages, or for any loss arising from your use of the app or from content posted by users. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us in the past twelve months or fifty US dollars.

You agree to indemnify and hold FestBites harmless from claims arising out of your content, your use of the app, or your violation of these terms.

You can stop using the app and delete your account at any time. We may suspend or terminate access if you break these terms or to protect the app and its users. Sections that by their nature should survive termination - including the content license, disclaimers, and limitation of liability - will survive.

We may update these terms from time to time. When we make material changes, we will update the date at the top of this page. Continued use of the app after a change means you accept the updated terms.

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules.
